Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) Data Reporting and Recordkeeping Under the Toxic Substances Control Act (TSCA); Change to Submission Period and Technical Correction
Summary

The Environmental Protection Agency EPA or Agency is proposing to amend the Toxic Substances Control Act TSCA regulation with reporting and recordkeeping requirements for perfluoroalkyl and polyfluoroalkyl substances PFAS that was finalized on October 11 2023. The final rule requires manufacturers including importers of PFAS in any year between 2011-2022 to report certain information to EPA beginning November 12 2024. EPA is proposing a one-time modification of the data submission period and a technical correction to amend a typographical error in the regulatory text. EPA is not proposing any changes to the scope of reporting under TSCA. EPA has concluded that a change to the submission period is necessary and in the public interest as the reporting application being developed to collect this data will not be fully functional by November 2024. The proposed revision of the submission period would facilitate compliance with the rule and help ensure that the collection includes accurate data on manufactured PFAS in the United States. EPA thus believes the proposed amendments are necessary and does not expect to receive any adverse comments.
